City explains process involving open records request involving financial statements

CITY ADDRESSES OPEN RECORDS REQUEST INVOLVING FINANCIAL STATEMENTS

MIDLAND, TEXAS -- The City of Midland has received several inquiries regarding a recent open records request involving financial statements for City-issued credit cards. To ensure clarity and transparency, the City is providing the following explanation of the process followed under the Texas Public Information Act.

The request was handled in full compliance with state law and the standard public information procedures.

During the review of responsive documents, the City identified a single line item that contains protected health information belonging to a City employee. Under Section 552.101 of the Texas Government Code, this type of information is confidential and must be withheld from public disclosure. This charge is an approved expense that the City incurred pursuant to an existing contractual obligation.

In accordance with the law, the City redacted that single line item, released all other responsive information to the requestor, and submitted an unredacted copy to the Office of the Attorney General for a ruling on whether the redacted information must remain confidential.

The City expects to receive a ruling within approximately 45 days and will promptly comply with that decision.

All other responsive information (with the exception of standard redactions required by law such as credit card numbers and personal health information) has been released.

The City of Midland does not issue City-funded credit cards to members of the Midland City Council.
